Terms and Conditions

These Terms of Service ("Terms") govern your access to and use of the MCSets marketplace platform ("Service"), operated by MCSets Limited, a company registered in Northern Ireland (Company No. NI735818). By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1. Acceptance of Terms

1.1. By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

1.2. If you are using the Service on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms.

1.3. We reserve the right to update these Terms at any time. Continued use of the Service after changes constitutes acceptance of the modified Terms.

2. Account Terms

2.1. You must be at least 13 years of age to create an account and use our Service. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

2.2. You are responsible for maintaining the confidentiality and security of your account credentials. You agree to notify us immediately of any unauthorized access to your account.

2.3. You are solely responsible for all content posted and activity that occurs under your account.

2.4. You may not use the Service for any illegal or unauthorized purpose, nor may you violate any laws in your jurisdiction.

2.5. You may not create multiple accounts for the purpose of evading bans, manipulating reviews, or circumventing platform rules.

2.6. Account sharing is prohibited. Each account must be used by a single individual.

3. Prohibited Conduct

3.1. You agree not to engage in any of the following prohibited activities:

• Scraping and Data Collection: Using any automated means, including robots, crawlers, scrapers, or spiders, to access, collect, copy, or monitor any portion of the Service or its content without our express written permission.

• Automated Access: Using any automated system, including bots, scripts, or macros, to access, interact with, or transact on the Service.

• Circumvention: Attempting to bypass, disable, or interfere with any security features, access controls, or usage limits of the Service.

• Reverse Engineering: Decompiling, disassembling, reverse engineering, or attempting to derive the source code of the Service or any part thereof.

• Interference: Interfering with or disrupting the integrity or performance of the Service, including DDoS attacks, spam, or resource exhaustion.

• Impersonation: Impersonating any person or entity, or falsely stating or misrepresenting your affiliation with any person or entity.

• Fraud: Engaging in any fraudulent activity, including but not limited to fake reviews, chargebacks fraud, or payment manipulation.

• Harassment: Harassing, threatening, or intimidating other users of the Service.

• Illegal Content: Uploading, posting, or distributing any content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable.

3.2. Violation of these prohibitions may result in immediate termination of your account and may be reported to law enforcement authorities.

4. User Terms (Buyers)

4.1. Purchase Agreement. When you purchase a product, you enter into a contract directly with the vendor. MCSets acts solely as a marketplace facilitator and is not a party to the transaction.

4.2. License Rights. Products are licensed according to the terms specified by each vendor. Unless explicitly stated otherwise, you may not redistribute, resell, share, or sublicense purchased products.

4.3. Marketplace Service Fee. A marketplace service fee applies to all purchases made using credit/debit cards or PayPal. For purchases of $10.00 USD or more, a 4% fee applies. For purchases under $10.00 USD, a flat fee of $0.40 USD applies. This fee covers payment processing, platform maintenance, and marketplace operations. The fee is calculated on the final purchase amount (after any applicable discounts or coupons) and is clearly displayed during checkout. No service fee applies to purchases made using cryptocurrency or when paying with MCSets Credits.

4.4. Refunds. Refund policies are determined by individual vendors. MCSets may facilitate refunds at its discretion but is not obligated to do so.

4.5. Product Support. Product support is provided by the vendor, not MCSets. We do not guarantee the quality, accuracy, or functionality of any vendor products.

5. Vendor Terms (Sellers)

5.1. Eligibility. To become a vendor, you must complete our verification process and comply with all applicable laws and regulations.

5.2. Product Listings. You are solely responsible for the accuracy of your product information, including descriptions, images, and pricing. Misleading or false information may result in removal and account termination.

5.3. Prohibited Content. You may not list products that: (a) infringe intellectual property rights; (b) contain malware, backdoors, or malicious code; (c) violate Minecraft's EULA or any other applicable terms; (d) contain illegal content; (e) are leaked, stolen, or obtained without authorization.

5.4. Original Work. You represent and warrant that all products you list are your original work or that you have obtained all necessary rights and permissions to sell them.

5.5. Commission. MCSets charges a commission on each sale. Current commission rates are displayed in your vendor dashboard and may be updated with notice. Unless otherwise stated in your vendor agreement, some sellers may qualify for reduced or 0% commission rates.

5.6. Payouts. Vendor payouts are processed according to our payout schedule. MCSets reserves the right to withhold payouts pending investigation of suspicious activity or policy violations.

5.7. Tax Responsibility. You are solely responsible for determining and fulfilling your tax obligations. MCSets may be required to collect tax information and report earnings to tax authorities.

6. Credits System

6.1. MCSets Credits are a virtual currency used on our platform. The exchange rate is 10 Credits = $1.00 USD.

6.2. Credit Purchase Fees. When purchasing Credits using credit/debit cards or PayPal, a marketplace service fee applies. For purchases of $10.00 USD or more, a 4% fee applies. For purchases under $10.00 USD, a flat fee of $0.40 USD applies. This fee is calculated on the final purchase amount (after any applicable discounts or coupons) and is clearly displayed during checkout. No service fee applies to Credit purchases made using cryptocurrency or giftcard redemptions.

6.3. Credits are non-refundable except as required by applicable law.

6.4. Credits do not expire. For buyers, Credits have no cash value and cannot be converted to fiat currency.

6.5. Credits cannot be transferred between accounts.

6.6. Vendor Withdrawals. Verified vendors may withdraw their earned Credits as fiat currency, subject to minimum withdrawal thresholds, processing fees, and payout schedules as displayed in the vendor dashboard.

6.7. MCSets reserves the right to modify, suspend, or discontinue the Credits system at any time with reasonable notice.

7. Intellectual Property

7.1. The Service, including its original content, features, functionality, design, and branding, is owned by MCSets Limited and is protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2. Vendors retain ownership of their content and grant MCSets a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute their content in connection with the Service.

7.3. You may not use MCSets' name, logo, or branding without prior written permission.

7.4. If you believe your intellectual property rights have been infringed, please contact us with details of the alleged infringement.

8. API and Third-Party Integrations

8.1. Access to any MCSets API is subject to separate API Terms of Service and rate limits.

8.2. Unauthorized API access, including scraping, excessive requests, or circumventing rate limits, is strictly prohibited.

8.3. MCSets may revoke API access at any time for any reason, including violation of these Terms.

8.4. Third-party integrations are provided "as is" and MCSets is not responsible for the functionality or security of third-party services.

9. User Content and Conduct

9.1. You retain ownership of content you submit to the Service, but grant MCSets a license to use, display, and distribute such content.

9.2. You are solely responsible for the content you post and represent that you have all necessary rights to post such content.

9.3. MCSets reserves the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.

9.4. Reviews must be honest and based on genuine experience with the product. Fake reviews, review manipulation, and review exchange schemes are prohibited.

10. Termination

10.1. We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

10.2. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive.

10.3. You may terminate your account at any time by contacting support. Termination does not entitle you to a refund of any Credits or purchases.

10.4. MCSets may retain certain information as required by law or for legitimate business purposes after account termination.

11. Disclaimers

11.1. THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2. MCSets does not warrant or guarantee the quality, accuracy, reliability, or availability of any products listed by vendors. Users purchase products at their own risk.

11.3. MCSets does not warrant that the Service will be uninterrupted, secure, or error-free.

11.4. MCSets is not responsible for any disputes between buyers and vendors.

12. Limitation of Liability

12.1. IN NO EVENT SHALL MCSETS LIMITED, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

12.2. Our total liability shall not exceed the greater of: (a) the amounts paid by you to MCSets in the twelve (12) months prior to the claim giving rise to such liability; or (b) $100 USD.

12.3. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so the above limitation may not apply to you.

13. Indemnification

13.1. You agree to defend, indemnify, and hold harmless MCSets Limited, its directors, officers, employees, and agents from and against any claims, damages, obligations, losses, liabilities, costs, or expenses arising from:

• Your use of and access to the Service

• Your violation of these Terms

• Your violation of any third-party rights, including intellectual property rights

• Any content you submit to the Service

14. Dispute Resolution

14.1. Any disputes arising out of or relating to these Terms or the Service shall first be attempted to be resolved through good-faith negotiation.

14.2. If a dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the courts of Northern Ireland, United Kingdom.

14.3. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

15. Governing Law

15.1. These Terms shall be governed by and construed in accordance with the laws of Northern Ireland, United Kingdom, without regard to its conflict of law provisions.

15.2. You agree to submit to the exclusive jurisdiction of the courts located in Northern Ireland for resolution of any disputes.

16. Severability

16.1. If any provision of these Terms is held to be unenforceable or invalid, such provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force and effect.

17. Entire Agreement

17.1. These Terms, together with our Privacy Policy and any other legal notices published on the Service, constitute the entire agreement between you and MCSets Limited regarding your use of the Service.

17.2. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

18. Changes to Terms

18.1. We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice via email or through the Service.

18.2. Your continued use of the Service after changes become effective constitutes acceptance of the revised Terms.

18.3. If you do not agree to the modified Terms, you must stop using the Service and may request deletion of your account.
